Is Delta 9 Legal in Alaska?

According to Alaska state law, Delta 9 THC is legal whether it is derived from hemp or marijuana plants. For hemp-derived Delta-9 THC, it must come from industrial hemp containing no more than 0.3% Delta-9 THC on a dry weight basis. Such products are legal in Alaska and can be used, possessed, purchased, sold, distributed, and produced under the protections of the 2018 Farm Bill and Alaska’s Senate Bill 27, which distinguishes between marijuana and industrial hemp and legalizes the cultivation and sale of hemp products.

Additionally, Alaska is a recreational cannabis state, meaning that adults aged 21 and over can legally use, possess, purchase, sell, distribute, and produce Delta-9 THC derived from marijuana plants, which can contain more than 0.3% Delta-9 THC on a dry weight basis.

Is Delta 8 Legal in Alaska?

Delta 8 THC is illegal in Alaska for both recreational and medicinal use. This means that the possession, use, sale, and distribution of Delta 8 THC are prohibited in the state. Despite the general legalization of recreational cannabis use in Alaska through Ballot Measure 2 in 2014, which allows individuals aged 21 and older to possess, use, and cultivate cannabis for personal use, this does not include Delta 8 THC. Therefore, Delta 8 THC remains illegal in all forms within Alaska.

Is THCA Legal in Alaska?

Yes, THCA is legal in Alaska. The state has a history of progressive cannabis laws, and the purchase and use of THCA are entirely legal. This accessibility is part of Alaska’s broader legalization of cannabis for recreational use, which was enacted in 2014. As a component of cannabis, THCA falls under the same legal framework that allows the sale and possession of cannabis and its derivatives.

While federal laws, such as the Controlled Substances Act, list marijuana as a Schedule I drug, the 2018 Farm Bill distinguishes between hemp and marijuana. Hemp, which contains low levels of THC, is legal. Since THCA can convert to THC, its legal status may depend on interpretation and the source of the compound. However, in Alaska, as long as the cannabis and its components, including THCA, comply with state regulations regarding factors like age and purchase location, the involvement with THCA remains within legal boundaries.
